Please join this series of webinars on September 7, 14 and 21 at 12:30 p.m. for an update on conservation easements and their potential impact on land disposition (e.g. estate planning and farm succession decisions). Robert Andrew Branan, JD, Assistant Extension Professor, NC State Department of Agricultural and Resource Economics, will deliver the series titled “Estate and Conservation Easement Planning from the Lawyers Perspective.”

This series is hosted by the NC Foundation as a the third round of training in the Conservation Easement Stewardship Training series for those NC Soil & Water Conservation Districts interested in expanding or developing a program to assist landowners with Conservation Easements or for general knowledge. The sessions are open to Cooperative Extension, other professionals and members of the public, and supported by the NC Tobacco Trust Fund Commission and the USDA Sustainable Agriculture and Research Education (SARE) Professional Development Program (PDP).
These sessions will focus on information for landowners, along with Extension Agents and Soil & Water staff who want to know more about Estate Planning processes, with or without easements.
The workshops will be offered as a “Lunch and Learn” virtual one-hour sessions, on three Wednesdays in Sept. (Time of sessions will be around the noon hour, but specific time will be forthcoming with registration announcement.)
To Cooperative Extension and Soil & Water personnel: please share this information with your landowners, other agricultural agencies in your County, S&W District staff and Board Members, Extension Advisory Board Members, Voluntary Ag District Board Members, etc. This may be an opportunity to invite landowners to the county office to listen during lunch time together, especially those who have expressed interest in farmland preservation or concerns over estate and farm succession planning.
Branan will organize the series presentations as follows:
September 7, 2022 : Part I: Rights in Real Property. A review of how land is acquired and titled, how such titling affects transfer options, as well as a review of rights in property held by other parties, including easements, rights of way, liens, leases, etc.
September 14, 2022: Part II: The Disposition of Real Property. A review of how property is transferred by sale, gift and death, including the legal documents involved (i.e sales contracts, options to purchase, wills and trusts [and LLCs]), as well as property, income, and estate and gift tax consequences.
September 21, 2022: Part III: The Impact of Conservation Easements on Real Property Transfer Decisions. An exploration of how the restrictions imposed by a conservation easement impact future transfer decisions and planning.
This training is made possible by the NC Foundation of Soil and Water Conservation by a grant from the NC Tobacco Trust Fund Commission. Additional support to Mr. Branan’s programming comes from SARE PDP and the “Land Summit Professional Development” Project.
